The RC-120 zoning is defined by Stonington as, "This zone encompasses coastal areas including coves, estuaries, tidal marshes and wetlands. It is created to preserve the natural habitat and to assure flood protection." RC-120 requires a non-infringement area of 100 ft minimum from Tidal Wetlands.
Is this property zoned RC-120? No! It is RA-15 Residential that allows excavating and fill, within inches of Tidal Wetlands without even getting a permit! What are they thinking here? The borough claims that Tidal Wetlands aren't their responsibility, it is up to the State to protect them. So much for Sustainability. The State has jurisdiction for Wetlands, but not the property adjacent to them. So there is a big loophole that nobody seems to care about …except residents.
Does this look like an ideal site for the construction of a huge dock with an elevated walkway as high as 11 ft above the ground?
