Applicant's Lawyer Cancels Mystic Harbor Management Commission Meeting!!

John Casey is an attorney in New London CT with Robinson Cole. He is representing the dock applicant and sent the email pictured above. Why he asked for a postponement is unclear since he provided no reason. Here are 3 possibilities:
1. DEEP has not concluded it's actions related to the violations of CT wetlands law at 28 Schoolhouse and 6 Heron. The senior DEEP site investigator has concluded there were significant violations at both properties. By policy, the dock proposal cannot move forward at DEEP until the wetlands violations process has concluded. The applicant's team may have felt that their chances of success at MHMC presentation would be hurt by the ongoing enforcement action.
2. They had not planned to proceed with the meeting, but wanted to wait until we submitted our documentation so they could modify their strategy. The postponement request came about 45min after we submitted our material to Mr. Casey and HMC. Kind of a dirty approach, but they did get our materials, caused us to waste time, and increased our legal fees.
3. After viewing the material we were presenting, they may have realized that the proposal would likely fail, and therefore cancelled in order to re-organize.
We have now experienced the applicant's team cancelling out of 4 Commission meetings. DEEP is investigating the applicant for breaking CT environmental law in two locations, and has forced the applicant to remediate wetlands damage at both sites. The property is not connected with the applicants residence, and is in fact, a shallow, fragile, wetlands area. On top of all this, the proposal is for a dock that can accommodate huge boats.
Hopefully the MHMC will have time to carefully read the material that we submitted. There is a considerable amount of information in our report and, given the precedent-setting nature of this case, it may be useful that they now have time to study it.
